ShopTerms and Conditions of Sale
This page is an English translation of the French legal notice and terms and conditions of sale, provided for information only. Only the French version is authoritative: in the event of any discrepancy, including in the statutory texts reproduced on this page, the French version prevails.
Terms and Conditions of Sale
Article 1 – Scope and acceptance
These terms and conditions of sale (the “Terms”) apply to sales of wines and other products offered on the website domaine-lalaurie.com. These sales are concluded between SARL JEAN CHARLES LALAURIE (the “seller”, identified in Article 2) and any person who places an order on the website (the “customer”).
The offers on the website are intended for private individuals and professionals, with the exception of retail businesses and large-scale retailers (hypermarkets, supermarkets, etc.). Certain rules benefit only a customer who is a consumer, that is, a natural person who is not buying for the purposes of their commercial, industrial, craft, liberal-profession or agricultural activity: the right of withdrawal (Article 8), the legal guarantee of conformity (Article 9) and consumer mediation (Article 11).
We deliver only within metropolitan France (Article 7).
The Terms can be accessed at any time from every page of the website and from the checkout page. The customer can save and print them. Before confirming the order, the customer must read and accept them by ticking the box provided for that purpose: if this box is not ticked, the order cannot be placed.
Each order is governed by the Terms in force on the day it is confirmed. The seller may amend the Terms, but a new version applies only to orders placed after it has been published online.
The sale of alcohol to minors is prohibited: only persons aged 18 or over may place an order (Article 13).
Article 2 – Identity of the seller
The products on the website are sold by:
- SARL JEAN CHARLES LALAURIE, trading name “Domaine Lalaurie”
- French private limited company (SARL) with a share capital of €7 622,45, Narbonne Trade and Companies Register (RCS) no. 420 043 689
- Intra-Community VAT number: FR05420043689
- Registered office and postal address: 2 rue Le Pelletier de Saint-Fargeau, 11590 Ouveillan, France
- Telephone: +33 4 68 46 84 96
- Email: lalaurie@domaine-lalaurie.com
It is to the seller that the customer must turn in order to enforce the legal guarantees described in Article 9.
Article 3 – Products and availability
The page for each product sets out its essential characteristics. We invite the customer to read it before ordering.
The order must correspond to the offer presented on the website, in particular to the formats and quantities offered and, where applicable, to the closing dates of the offer.
Products are sold while stocks last. It may happen that, after the order has been confirmed, a product is unavailable, or is lost or destroyed before delivery and cannot be replaced by an identical product. In that case, the seller informs the customer as soon as possible and refunds, within 14 days at the latest, the sums paid for the products that cannot be delivered. The customer may also cancel the entire order: the customer is then refunded all sums paid, including delivery charges, no later than 14 days after notifying the seller of that decision (Articles L216-6 and L216-7 of the French Consumer Code). In both cases, the customer retains the right to claim damages.
Article 4 – Placing an order
Orders are placed online, without creating a customer account, in the following steps:
- choosing the products and quantities, then adding them to the basket;
- reviewing the basket, where the customer can change quantities or remove products;
- on the checkout page: entering billing and delivery details (in particular the email address, which is used to identify the customer, and a telephone number), then choosing the delivery method (and the pick-up point, where applicable) and the payment method;
- checking the order summary: products, quantities, prices, delivery charges and total price;
- accepting these Terms by ticking the box provided for that purpose;
- declaring that the customer is of legal age, by ticking the box “I certify that I am at least 18 years old”;
- confirming the order by clicking the “Order with obligation to pay” button;
- payment: for payment by bank card, entering the card details on the secure Up2pay e-Transactions page (Crédit Agricole); for payment by cheque, sending the cheque as described in Article 6.
Until they click “Order with obligation to pay”, the customer can check the details and the total price of their order and correct any input errors. They can return to the basket to change quantities or remove products, and can change the information entered on the checkout page at any time. We recommend that the customer carefully checks their delivery information: full address, access or entryphone code, and a telephone number on which they can be reached during the day.
The contract of sale is concluded when the customer clicks the “Order with obligation to pay” button. This click constitutes acceptance of the order and obliges the customer to pay its price. The customer retains their right of withdrawal (Article 8).
Once the order has been confirmed, its number and summary are displayed on screen. The seller acknowledges receipt of the order and sends the customer confirmation of it by email, to the address given when ordering. This message sets out the information relating to the order. It contains a link to these Terms and to the “Withdraw from contract here” function.
The seller may cancel an order only for a legitimate reason: product unavailable (Article 3), payment not received (Article 6) or failure to prove that the customer is of legal age (Article 13). The customer is then informed and, if they have already paid, is refunded within 14 days at the latest.
The contract is concluded in French. An English translation of the Terms is provided for information; if the two versions differ, the French version applies.
Article 5 – Prices and delivery charges
Product prices are displayed in euros, inclusive of all taxes (including VAT). They do not include delivery charges: these are added to the price in accordance with the rules below and are shown before the order is confirmed.
The seller may change its prices at any time. The customer pays the prices and delivery charges in force at the time they confirm their order, as shown in the order summary.
Delivery charges. The amount depends on the number of bottles ordered and on the delivery method:
- up to 12 bottles: shipped by Colissimo, to a pick-up point or to the customer’s home against signature. The price varies according to the number of bottles and the method chosen. The rates are set out on the Shop page, and the exact amount is shown before the order is confirmed;
- more than 12 bottles: home delivery by carrier, by appointment, for €50 including VAT up to 36 bottles and €70 including VAT for more than 36 bottles.
For this calculation, a bag-in-box (BIB) counts as 6 bottles, a gift box as 3 bottles and a magnum as 2 bottles.
Free delivery. Delivery is free if the amount of the purchases reaches €300 including VAT, after deduction of discounts. For orders confirmed on or after 1 November 2026, this threshold rises to €350 including VAT.
Article 6 – Payment
The customer pays the total price of the order (products and delivery charges) in a single payment, in euros, at the time of ordering, by one of the following methods:
- Bank card: payment is made on the secure page of Up2pay e-Transactions, a Crédit Agricole service. The customer enters their card details directly with this service provider: the details do not pass through the website and the seller has no access to them.
- Cheque: in euros, drawn on a French bank, payable to SARL Jean-Charles LALAURIE. It should be sent to: SARL JEAN CHARLES LALAURIE – Domaine Lalaurie, 2 rue Le Pelletier de Saint-Fargeau, 11590 Ouveillan, France. The customer writes on the back of the cheque the order number displayed at the end of the ordering process. The order is shipped once the cheque has been received.
If payment fails (card declined, cheque not received, etc.), the customer may contact the seller to pay by another accepted method. If no payment is received within 10 days of the order, the order is cancelled.
Retention of title. The seller remains the owner of the products until the price has been paid in full (Articles 2367 et seq. of the French Civil Code). This rule does not affect the transfer of risk provided for in Article 7.
Article 7 – Delivery
Delivery area. We deliver only within metropolitan France, to the address given by the customer when ordering. Collection of orders on site is not offered.
Delivery methods. For up to 12 bottles (applying the equivalences in Article 5), the order is delivered by Colissimo, to a pick-up point or to the customer’s home against signature, as the customer chooses. For more than 12 bottles, it is delivered to the customer’s home by a carrier, by appointment.
The customer must provide a complete and accurate delivery address, and a telephone number on which they can be reached. If the customer wishes to change the delivery address, they must inform the seller as soon as possible and, in any event, before the parcel is handed over to the carrier.
Delivery time. The seller delivers the order within a maximum of 15 working days from the conclusion of the contract, unless a different date or period has been agreed with the customer at the customer’s request (Article L216-1 of the French Consumer Code). This period is shown again on the checkout page.
Late delivery. If the order is not delivered within this period, the customer has the following rights (Article L216-6 of the French Consumer Code):
- they may inform the seller that they are suspending payment of all or part of the price still owed, until the seller delivers;
- they may ask the seller in writing (by letter or email) to deliver within a reasonable additional period. If the seller does not deliver within that period, the customer may cancel (terminate) the contract. The contract is terminated as soon as the seller receives the written notice informing it of this, unless delivery has taken place in the meantime;
- they may cancel the contract immediately if the seller refuses to deliver or if it is clear that the seller will not deliver. They may also do so if the delivery date or period was an essential condition for them, because of the circumstances of the order or because they had expressly requested it before ordering.
If the contract is cancelled, the seller refunds the customer all sums paid, no later than 14 days after the date on which the customer cancelled the contract (Article L216-7). The customer may also claim damages. If the refund is late, the sum due is automatically increased in accordance with Article L241-4 of the French Consumer Code.
Transfer of risk. During transport, the risk of loss of or breakage to the products lies with the seller. The risk passes to the customer when the customer, or a person designated by them, takes physical possession of the products (Article L216-2 of the French Consumer Code).
Damaged or incomplete parcel. We advise the customer to check the condition of the parcel and its contents on delivery. If they notice any damage (breakage, leakage, damaged packaging) or that a product is missing, they may, where possible, report it to the carrier by recording specific reservations (for example on the delivery note). They may also let us know promptly by email or telephone, with photographs if possible: this helps us to make a claim against the carrier. This is only a recommendation: no particular form or time limit is required, and the customer loses no rights if they do not follow it. Even if no reservations are made on receipt, the seller remains bound by the legal guarantee of conformity (Article L216-5 of the French Consumer Code and Article 9 of these Terms).
Article 8 – Right of withdrawal
Period. A customer who is a consumer may withdraw, that is, renounce their order, without having to give any reason, within a period of 14 days (Articles L221-18 et seq. of the French Consumer Code). This period ends 14 days after the day on which the customer, or a person designated by them (other than the carrier), takes physical possession of the products. If the products in a single order are delivered separately, the period runs from receipt of the last product. The customer may also withdraw as soon as the contract has been concluded, without waiting to receive the products.
The day of receipt is not counted. The period ends at the end of the last day. If that last day falls on a Saturday, a Sunday or a public holiday or non-working day, the period is extended until the next working day (Article L221-19).
How to withdraw. The customer must inform the seller of their decision to withdraw before the period expires, by means of a clear declaration. They may, as they choose:
- use the online function Withdraw from the contract here, available at https://domaine-lalaurie.com/renoncer-au-contrat-ici/?lang=en and through the “Withdraw from the contract here” link at the bottom of every page of the website. It is free of charge and available throughout the withdrawal period. The customer enters the information that makes it possible to identify them and to find their order, then confirms their declaration. An acknowledgement of receipt is then displayed on screen. In addition, the seller sends the customer, as soon as possible, an acknowledgement of receipt of the withdrawal on a durable medium (by email), setting out its content and the date and time it was submitted;
- send an email to lalaurie@domaine-lalaurie.com;
- send a letter to: SARL JEAN CHARLES LALAURIE – Domaine Lalaurie, 2 rue Le Pelletier de Saint-Fargeau, 11590 Ouveillan, France;
- use the model withdrawal form reproduced below (this is not compulsory).
The deadline is met if the customer sends their declaration before the period expires. It is for the customer to prove that they withdrew within the period (Article L221-22): the acknowledgement of receipt, the email sent or proof of postage of the letter may serve as proof.
Return of the products. The customer returns the products to: SARL JEAN CHARLES LALAURIE, 2 rue Le Pelletier de Saint-Fargeau, 11590 Ouveillan, France. They must do so without delay and no later than 14 days after informing the seller of their withdrawal (Article L221-23). The deadline is met if the products are sent before it expires. The direct costs of returning the products are borne by the customer. For an order of more than 12 bottles (equivalences in Article 5), which cannot normally be returned by post, the seller will provide the customer, on request and before any return, with an estimate of the cost of such a return by carrier, which remains payable by the customer. We recommend using packaging suitable for transporting bottles.
If several products are sold together, as a set or in a gift box, for an overall price, the withdrawal applies to the entire set or gift box.
Refund. Following a withdrawal, the seller refunds the customer everything they have paid, including the initial delivery charges. There is one exception: if the customer chose a delivery method more expensive than the least expensive standard delivery method offered by the seller, the difference is not refunded. The refund is made without undue delay and no later than 14 days after the seller has been informed of the withdrawal (Article L221-24). However, the seller may wait until it has received the products, or until the customer has sent it proof that they have been dispatched. Whichever of these two dates is earlier applies.
The refund is made using the same means of payment as the order: to the bank card used, or by cheque if the order was paid by cheque. Another means may be used if the customer expressly agrees. The refund is free of charge for the customer.
Damaged products. The customer is liable only if the products have lost value because they handled them beyond what is necessary to establish their nature, characteristics and proper functioning (Article L221-23).

Article 9 – Legal guarantees
The seller, SARL JEAN CHARLES LALAURIE (2 rue Le Pelletier de Saint-Fargeau, 11590 Ouveillan, France; telephone: +33 4 68 46 84 96; email: lalaurie@domaine-lalaurie.com), owes the customer the legal guarantee of conformity (Articles L217-1 to L217-32 of the French Consumer Code) and the legal guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code). To enforce these guarantees, the customer contacts the seller by any of these means and describes the defect found. Photographs are helpful.
Legal guarantee of conformity. The seller must deliver products that conform to the contract. It is liable for any lack of conformity that exists at the time of delivery and becomes apparent within two years of delivery (Article L217-3). A defect that becomes apparent within 24 months of delivery is presumed to have existed at the time of delivery, unless proven otherwise or unless this presumption is incompatible with the nature of the product or of the defect (Article L217-7). The customer chooses between repair and replacement of the product. The product is brought into conformity free of charge and no later than 30 days after the customer’s request (Articles L217-9 and L217-10). The customer may obtain a price reduction or termination of the sale in four cases: if the seller refuses to bring the product into conformity; if this takes place after 30 days or causes the customer major inconvenience; if the defect persists despite the attempt to bring the product into conformity; or immediately, if the defect is so serious that it justifies this. Termination is excluded if the defect is minor, which it is for the seller to prove (Article L217-14). In the event of termination, the customer returns the products at the seller’s expense, and the seller refunds the price paid (Article L217-16). Any refund due on this basis is paid no later than 14 days after the seller has received the product or proof that it has been sent back (Article L217-17).
Guarantee against hidden defects. The seller is liable for hidden defects in the product which make it unfit for its intended use, or which impair that use to such an extent that the customer would not have bought it, or would have paid less for it, had they known of them (Article 1641 of the French Civil Code). The customer must bring an action within two years of discovering the defect (Article 1648). They may then choose between returning the product and having the price refunded, or keeping the product and obtaining a price reduction (Article 1644).
The absence of reservations on delivery does not deprive the customer of either the legal guarantee of conformity (Article L216-5 of the French Consumer Code) or the guarantee against hidden defects.
Official French text (French Consumer Code), which prevails:
1° Le professionnel refuse de réparer ou de remplacer le bien ;
2° La réparation ou le remplacement du bien intervient après un délai de trente jours ;
3° La réparation ou le remplacement du bien occasionne un inconvénient majeur pour le consommateur, notamment lorsque le consommateur supporte définitivement les frais de reprise ou d’enlèvement du bien non conforme, ou s’il supporte les frais d’installation du bien réparé ou de remplacement ;
Article 10 – Customer service and complaints
For any question or complaint about an order, the customer may contact the seller’s customer service:
- by email: lalaurie@domaine-lalaurie.com;
- by telephone: +33 4 68 46 84 96;
- by post: SARL JEAN CHARLES LALAURIE – Domaine Lalaurie, 2 rue Le Pelletier de Saint-Fargeau, 11590 Ouveillan, France.
The seller endeavours to settle amicably any difficulty relating to an order or its delivery. If the disagreement persists, the customer may refer the matter free of charge to a court-appointed conciliator (conciliateur de justice) or bring proceedings before the competent court (Article 16). They will also be able to refer the matter to the consumer mediator as soon as the mediator’s contact details appear in Article 11.
Article 11 – Consumer mediation
Every customer who is a consumer has the right to refer a dispute with the seller, free of charge, to a consumer mediator in order to seek an amicable settlement (Articles L612-1 et seq. of the French Consumer Code). Before referring the matter to the mediator, the customer must first have attempted to settle the dispute directly with the seller by means of a written complaint (Article 10).
The name, address and website of the consumer mediator competent for the seller will be given in this article as soon as the mediator has been appointed. In the meantime, the customer may also refer the matter free of charge to a court-appointed conciliator. In all cases, the customer may bring proceedings before the competent court (Article 16).
Article 12 – Force majeure
Neither the seller nor the customer is liable if they are unable to perform their obligations because of an event of force majeure within the meaning of Article 1218 of the French Civil Code, namely an event beyond their control which could not reasonably have been foreseen when the contract was concluded and whose effects cannot be avoided by appropriate measures. If the impediment is temporary, performance of the contract is suspended, unless the resulting delay justifies termination of the contract. If the impediment is permanent, the contract is terminated automatically and the customer is refunded all sums paid.
Article 13 – Protection of minors and health warning
The law prohibits the sale of alcoholic beverages to minors (Article L3342-1 of the French Public Health Code). Consequently, only persons aged 18 or over may place an order. Before confirming their order, the customer must tick the box “I certify that I am at least 18 years old”: if this box is not ticked, the order cannot be placed.
Proof that the customer is of legal age is required at the time of the online sale (Article L3342-1 of the French Public Health Code). In addition to the certification box, the seller may ask the customer, before shipping, for a copy of an identity document (see the privacy policy). If the customer does not prove that they are of legal age, the order is cancelled and the sums paid are refunded within 14 days at the latest.
Alcohol abuse is dangerous for your health; consume in moderation. (L’abus d’alcool est dangereux pour la santé, à consommer avec modération.)
Article 14 – Personal data
The information marked as mandatory when ordering is necessary to process, deliver and invoice the order. Without it, the order cannot be recorded.
The telephone number requested when ordering is used solely for the follow-up and delivery of the order. It is prohibited to canvass a consumer by telephone without their prior consent (Article L223-2 of the French Consumer Code).
SARL JEAN CHARLES LALAURIE is the controller of this data. The data is used by the seller and by the service providers involved in performing the order (in particular for payment, transport and hosting of the website). The customer has the rights of access, rectification, erasure, restriction, objection and portability in respect of their data. The customer may exercise these rights by email to lalaurie@domaine-lalaurie.com or by post to the seller’s registered office. They may also lodge a complaint with the CNIL (the French data protection authority).
Article 15 – Archiving of contracts
Orders are archived in electronic form. For any order of €120 or more, the seller keeps the document recording the contract until delivery and then for 10 years from delivery (Articles L213-1, D213-1 and D213-2 of the French Consumer Code). The customer may access it at any time on simple request, by email to lalaurie@domaine-lalaurie.com or by post to the seller’s registered office.
Article 16 – Governing law and disputes
These Terms and the sales they govern are subject to French law. This choice does not deprive a customer who is a consumer of the protection afforded to them by the mandatory rules of law.
In the event of a dispute, we invite the customer first to contact customer service (Article 10). They may also refer the matter to a court-appointed conciliator and, as soon as the mediator’s contact details appear in Article 11, to the consumer mediator. If no amicable solution is found, a customer who is a consumer may bring proceedings, at their choice, before one of the courts having jurisdiction under the French Code of Civil Procedure, or before the court for the place where they were living at the time the contract was concluded or when the damage occurred (Article R631-3 of the French Consumer Code).
