Providing the personal information collected for the purposes of distance selling is mandatory, as this information is essential for orders to be processed and delivered correctly. Failure to provide it will prevent the order from being validated.

Alcohol abuse and protection of minors

In application of article L. 3342-1 of the French Public Health Code, which prohibits the sale of alcohol to minors under eighteen (18) years of age, by validating their order the customer undertakes to be at least eighteen years of age on the date of the order.

ARTICLE 1: APPLICATION OF THE TERMS AND CONDITIONS OF SALE

These Terms and Conditions of Sale govern the sale of the products found on the online shop of the Domaine Lalaurie wine estate. They are made available to the buyer on the order page.

By ticking the box “I have read and accept the terms and conditions of sale” before validating the order, the Customer expressly accepts these Terms and Conditions of Sale in full and without reservation, to the exclusion of any other document such as brochures or catalogues issued by the seller, which are indicative only.

Any subsequent amendment to the Terms and Conditions of Sale shall apply only to sales concluded after the amendment, the dates shown on the order acknowledgement sent to the buyer being authoritative.

The offers on this website are reserved exclusively for private and professional customers, to the exclusion of all retail businesses and large retailers (hypermarkets, supermarkets, etc.).

Domaine Lalaurie reserves the right to request from any new customer proof of identity and of address before the final validation of their first order.

The website serves the French market. Domaine Lalaurie does not deliver outside mainland France.

ARTICLE 2: PRICES

Our selling prices are those shown on the website at the time of the order. The electronic catalogue is updated regularly.

We reserve the right to change our prices at any time in line with promotions, variations in raw materials, our suppliers’ prices, or because of possible typographical errors in the display of those prices.

Prices are inclusive of all taxes, in euros. Shipping costs are charged in addition. They vary according to the quantities ordered. The amount of the shipping costs is displayed while the order is being placed.

ARTICLE 3: CONTENT OF THE ORDER

The order must comply strictly with the offer as published on the website, in particular with the formats and quantities offered and with the closing dates.

ARTICLE 4: ORDERING STEPS

Placing an order implies that the customer has first read these terms and conditions, the price and the essential characteristics of the wines chosen, which are available on the website.

Orders are placed through the “Basket” (electronic order form) accessible online on the Domaine Lalaurie website.

The buyer provides the information requested that is necessary to complete the order. In doing so they take care not to omit any information essential to the correct execution of the delivery:

Precise information concerning the delivery (delivery address different from the billing address, daytime telephone number, any building access code, entryphone code, etc.).

The buyer is identified by their email address.

The buyer accepts the order by clicking “validate” after choosing their payment method and entering the details requested to allow payment in the fields provided.

Their acceptance is then final, subject only to the possible exercise of the right of withdrawal described below.

Domaine Lalaurie confirms the order to the buyer by email summarising the order; a link allowing the order to be tracked is included in the email.

Every order is considered firm and final upon receipt of payment and confirmation by our services.

ARTICLE 5: PAYMENT DATE

No order of wine or accessories can be validated unless it is accompanied by payment (bank card, cheque) of the full price inclusive of tax.

If the cheque or transfer is not received by Domaine Lalaurie within ten days of the order at the latest, the order is automatically cancelled.

ARTICLE 6: MEANS OF PAYMENT

By bank card, in euros (Carte Bleue, Visa, Eurocard/Mastercard), by entering in the field provided for this purpose (secure online payment via PayPal) your card number, without spaces between the digits, together with its expiry date and the three-digit security number on the back of your card.
Banking information is encrypted and cannot be decoded. Domaine Lalaurie has no access to your bank card information; we receive only the email confirming that your payment has been successfully processed.

By cheque in euros, payable through a French bank, made out to Domaine Lalaurie. Write the order number (given at the end of the order) on the back of the cheque and send your payment to the following address:

In the event of a payment delay (bank card refused, cheque not honoured, etc.), it is for the customer to settle their order by any other appropriate means, failing which the order will be cancelled after 10 days.

ARTICLE 7: TRANSFER OF OWNERSHIP

Domaine Lalaurie retains ownership of the goods sold until they have been paid for in full by the buyer (French Act no. 80-335 of 12 May 1980).

ARTICLE 8: AVAILABILITY OF GOODS

Offers are always made subject to available quantities. Should the wines ordered be unavailable and the order consequently cancelled, the price will be refunded to the buyer as soon as possible.

ARTICLE 9: DESTRUCTION

Should the goods be destroyed before the date scheduled for delivery of the order, and in the absence of available stock to replace them, the buyer will be refunded the sums paid by them, to the exclusion of any other compensation, within 30 days of the date of the loss.

ARTICLE 10: DELIVERY

The order specifies the place of delivery or, where applicable, the buyer’s wish to collect the goods themselves from the seller’s cellars. The buyer must take receipt of or collect the goods within a maximum of 1 month following receipt of their order.

Any change to the place of delivery must be notified by the buyer to the seller in good time and, in any event, before the order is handed over to the carrier.

The indicative standard delivery time is 7 working days following the day the validated order is processed (orders are processed within 48 hours of validation), Monday to Friday, between 9 a.m. and 6 p.m., save in exceptional circumstances.
If, exceptionally, the buyer finds that delivery has not taken place within the times indicated above, they must inform Domaine Lalaurie immediately so that we can remedy the problem as quickly as possible, the order then having to be fulfilled within 30 days at the latest.

Presentation of the goods at the place and on the date indicated by the buyer releases the seller from its obligation to deliver.
If the buyer is absent when the goods are presented, the road carrier will, as far as possible and depending on the circumstances, contact the buyer for a second delivery, provided however that the buyer has given a telephone number on which they can be reached at any time for the delivery to be carried out correctly.

If the buyer has chosen to collect the goods, or have them collected, from the seller’s cellars, they will be released only to the person who placed the order. Proof of identity will be requested to confirm their identity. If the person who placed the order cannot come to the cellars, they may ask a third party to attend in their place. That person must carry a written authorisation drawn up by the person who placed the order, together with a copy of one of their identity documents.

The buyer must check the condition of the packaging and the contents of the parcel or parcels on delivery. In the event of damage or non-conformity, the buyer must without fail record reservations on the delivery note, specifying the anomalies observed, and inform Domaine Lalaurie within 48 hours of receiving the wines, by registered letter with acknowledgement of receipt. If breakage is observed, the buyer must refuse the damaged parcel, note this on the carrier’s delivery note and inform Domaine Lalaurie under the conditions set out above.

ARTICLE 11: RIGHT OF WITHDRAWAL

A right of withdrawal is available to the buyer under article L.121-20 of the French Consumer Code.

On receipt of the goods, the buyer has 14 clear days to return the product to Domaine Lalaurie and request a refund.

Where the deadline expires on a Saturday, a Sunday or a public or non-working holiday, it is extended to the first following working day.

Products damaged after delivery will not be taken back.

A buyer exercising this right is obliged to return the goods ordered to the seller’s cellars, under their own responsibility and at their own expense.

Where goods have been sold as part of a promotional lot, the entire lot must be returned to Domaine Lalaurie, since the order and the overall price invoiced are indivisible.

The buyer will be refunded within 30 days of the goods being returned.

ARTICLE 12: QUALITY OF THE WINES

Domaine Lalaurie cannot be held liable for any deterioration in quality caused by the transport of the wine.

ARTICLE 13: FORCE MAJEURE

Domaine Lalaurie cannot be held liable for loss, damage or failure to deliver an order arising from an event of force majeure (such as natural disasters, strikes or road accidents); these cases are in addition to those usually accepted by French case law.

ARTICLE 14: JURISDICTION

The Domaine Lalaurie Customer Service is at your disposal to settle amicably any problem arising from an order and its fulfilment. Should it prove impossible to reach an agreement, all disputes arising from the fulfilment of an order or from the interpretation of these terms and conditions, and more generally from agreements of any nature concluded between the parties, shall be referred to the court having jurisdiction over the registered office of Domaine Lalaurie.

ARTICLE 15: ARCHIVING

Article L.134-2 of the French Consumer Code: Domaine Lalaurie is required to keep, for 10 years from delivery of the goods, the written record of the contract concluded electronically, where that contract concerns a sum greater than 120 euros.

LANGUAGE OF THE CONTRACT

These Terms and Conditions of Sale are a translation provided for information purposes. The contract is concluded in French and is governed by French law. In the event of any discrepancy between this English version and the French version, the French version shall prevail.
